Under Article 52 of Legislative Decree 06/09/2005 n.206 ("Consumer Code") and subsequent amendments and additions referred to Legislative Decree. n. 21/2014, the customer is entitled to withdraw from the contract signed with the Seller without penalty and/or reason, and without incurring any costs other than those provided for by Article. 56 paragraph 2 and article 57 of Legislative Decree N. 21/2014 within fourteen (14) days from the day you received the products purchased on www.cangiari.com.
Under Article 54 of the Consumer Code, the right of withdrawal may be exercised, at the choice, one of the following ways:
1) using the Return Form (according to the standard form in accordance with art. 49, paragraph 4 of the Consumer Code), which is available online in the Customer Service ( "Personal" -> "History of orders" -> Specific order details -> Flag the box next to each product for which you require the return -> Fill in the text area -> Click on the button "Return") to be completed in its entirety to get the return number (the Seller will send you a confirmation by e-mail of the receipt of the withdrawal request submitted by the Return form);
2) sending to the Seller other unequivocal statement of intention to withdraw from the contract, without prejudice, in such case, which will remain the responsibility of the customer to prove the correct and timely exercise of the right of withdrawal.
The items must be delivered to the courier within fourteen (14) days from the date on which the customer has informed the Seller about he decision to terminate the contract.
In some specific cases, duly reported in the Return Form, you can still change the chosen item with another just for once.
Under Article. 59 of the Consumer Code, the right of withdrawal is excluded in the case of purchase of tailored or costumised products or sealed goods which are not suitable to be returned for hygienic reasons or related to the protection of health and were unsealed after delivery, such as, but not limited to items of category "Cosmetics" which sealed package has been opened.
If the customer exercises his right of withdrawal after having made a request under Article 50, paragraph 3 or Article 51, paragraph 8, the latter shall pay to the Company Made in GOEL reasonable costs within the meaning of 'Article 57 paragraph 3 of the Consumer Code.
I. Terms and conditions for exercising the right of withdrawal pursuant to art. 52 of the Consumer Code
The right of withdrawal is exercised properly if the following conditions are fully met:
a) within fourteen (14) days from receipt of goods, the customer must successfully fill and transmit: the Return Form from the Customer Service or, alternatively, fill and submit other unequivocal statement of the will of withdrawal to Made In GOEL scspa, via Lazio n. 43, Gioiosa Ionica (RC) by telegram or fax to the number 0964/419191;
b) the products have not been used, worn, washed or damaged;
c) the label must still be attached to the products to be handled with due diligence;
d) the products must be returned in their original packaging (the packaging must be sealed as in the origin);
e) returned items must be delivered to the courier chosen within fourteen (14) days from when it was announced to Made in GOEL the decision to terminate the contract and mailed to the address Made in GOEL via Palermo n. 7-89046 Marina di Gioiosa Ionica (RC);
f) products must not be damageAuthorized returns must be shipped from the same country in which the original order was delivered.
In compliance with all the conditions required, MADE IN GOEL pursuant to art. 56 of the Consumer Code fully refunds the price of the purchased products, possibly including the delivery costs.
Only the costs of the return, namely those for the return to MADE IN GOEL of purchased products, are charged to the customer, except MADE IN GOEL has expressly exempted from such charges at the time of purchase and the further condition that the customer makes use of the Courier indicated in the Return form (DHL).
The customer will be contacted by e-mail if the returned products can not be accepted because they do not comply with the above conditions under a), e) and f) of the preceding paragraph. In this case, the customer can choose to have the products delivered at his own expense. In case of refusal of the shipment MADE IN GOEL reserves the right to retain the products and the amount corresponding to the purchase price of the same.
Moreover the customer will also be contacted by email if the returned products can not be accepted because it does not comply with the above conditions b) letters c) and d) of the preceding paragraph. In this case, the customer can choose whether to accept the deduction of the refund, which will be communicated, due to the decrease in the value of the returned products, or if having the products delivered at his own expense. In case of refusal MADE IN GOEL reserves the right to retain the products and the amount specified for the curtailment of the reimbursement due to the decrease in the value of the returned products
II. Refunds Times and Methods
Under Article. 56, paragraph III of the Consumer Code, only after MADE IN GOEL has received the returned goods and checked that all requirements have been met, a return accepance confirmation email will be sent to the customer and MADE IN GOEL will reimburse integrally, or, if the existence of a decrease in value of the returned product is found, the customer will receive an e-mail in which he will be informed of the amount deducted by way of repayment and MADE iN GOEL will reimburse the remaining portion due.
Whatever the method of payment used by the customer (credit/debit card, cash on delivery), once verified that the withdrawal took place in compliance with the conditions imposed, Made in GOEL reimburse without undue delay and in any case within fourteen days from the day when the customer is informed of the decision to withdraw from the contract in accordance with Article 54; however, under paragraph III, Made in GOEL may withhold the reimbursement until it has received the returned goods.
The actual time for crediting or returning the amounts paid for the purchase of products will depend on the method of payment used. The refund will be issued in the same currency of original purchase. Any amount of differences due to exchange-rate fluctuations can not be refunded.
If a present, the repayment of the sums will be made to the person who made the payment.
III. Conditions for the exchange of products
Only in cases duly reported in the return form, as an alternative to the exercise of the right of withdrawal, the customer can change the products purchased by others, rather than a refund of its price.
The change request will be provided in the following limits:
a. Only those products purchased may be subject to change, for them this possibility will be expressly provided in the Return Form;
b. you can ask for a change of one or more products purchased with other models or products. In any case, the options available for the change will be indicated in the Return/Change Form;
c. you can ask for a change of one or more products purchased no later than fourteen (14) working days from the date of their submission, by completing the Return/Change Form, to be sent electronically to firstname.lastname@example.org within that deadline. The products to be changed must be delivered to the courier within fourteen (14) days of service since the customer has notified to MADE IN GOEL his decision to change the products.
d. a single change request for each product purchased may be made;
e. the products for which the change is requested must be returned to MADE IN GOEL in their original packaging, unused, or worn, washed or damaged, and the identification tag must still be attached;
f. the products to be changed. part of a single order, must be sent to MADE IN GOEL in a single shipment. The latter, in fact, reserves the right not to accept a single order products, sent for the change at different times;
g. all the products which cost the same or less than those bought can be changed; in the latter case it will not be recognized to the customer a refund.
If all the conditions mentioned above are properly respected, once completed and submitted the Return Form containing the request for change, MADE IN GOEL will process the same substitution request by sending a confirmation e-mail . The shipping charges will be borne entirely by the customer.
IV. Change timing and procedures
After receiving the products to be changed and checked that all the requirements set out above have been met, MADE IN GOEL will verify the actual availability of models or selected products at its stores.
If the product or products selected for the change should not be available at its stores, MADE IN GOEL could not accept the request for return, and it will proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with the provisions of the Consumer Code and in the manner prescribed in this statement.
In the event that the product or products selected for the change become available, MADE IN GOEL will welcome the change request, and send an e-mail confirming the shipment of replacement products. The shipment will take place in this case within thirty (30) days from the date on which MADE IN GOEL will become aware of the change request, once verified that the same has taken place in compliance with the above conditions in this statement. The shipping costs of substitutes will be charged to the customer.
Where the price of the product purchased is lower or higher than the price of the selected product for return, the customer will be contacted in the event that its exchange request can not be accepted because it does not comply with the above conditions in this statement. In this case, the customer can choose to have the products wished to be changed at their own expense. In case of refusal, MADE IN GOEL reserves the right to retain the products and using also one of the above assumptions in this statement, may deduct the amount corresponding to the purchase price of the products, ie the amount indicated for the curtailment of the reimbursement due to the decrease in the value of the returned products.
The replacement product or products may be the subject of subsequent restitution pursuant to art. 52 of the Consumer Code and as provided above.
V. Product identifier card
All products offered for sale by MADE IN GOEL come with an identification card, which is part of the good. The product must not be deprived of the card. Furthermore, pursuant to art. 57, paragraph II, of the Consumer Code, the Customer will be responsible for the diminished value of products returned to Made in GOEL, resulting in an utilization of products which is different from the one required to determine its nature, characteristics and functioning.
VI. - Products returning
In case of return, the customer will have to pay directlyfor transport costs and will remain dependent on him the responsibility in case of loss or damage of goods during transport.
VII. Consumer Code
These Conditions for exercising the right of withdrawal, which form an integral part of the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and subsequent amendments and additions. In all matters not specifically expressed, evidence shall be the European standard for remote trading.
